Amazing
It stuns me that they thought they'd get away with it. I read a story of a guy whose girlfriend bought him one, and he took it back for a refund. He told them it was illegal, and wanted his money back. The kiosk guy refused to believe him, and only refuneded the money after an argument and a call to his boss - at one point even booting the device and pointing to the "nintendo" logo as proof that it was legal.
